Terms and Conditions of Wheel Have

Welcome to Wheel Have! These Terms and Conditions (“Terms”) govern your use of our website www.wheelhave.com (the “Site”) and related services (collectively, the “Platform”). By accessing or using the Platform, you agree to these Terms. If you do not agree, you may not use Wheel Have.

1. Definitions
“Wheel Have,” “we,” “our,” or “us”: Refers to Wheel Have and its affiliates.
“Platform”: Refers to the Wheel Have website and associated services.
“User,” “you,” or “your”: Refers to any person or entity using the Platform.
“Seller”: Refers to individuals or businesses listing products for sale.
“Buyer”: Refers to individuals or businesses purchasing products.
“Listing”: Refers to products or services posted for sale on the Platform.

2. Eligibility and Account Registration
2.1 Eligibility
– You must be at least 18 years old.
– You must have the legal capacity to enter into agreements.

By registering or using Wheel Have, you confirm that you meet these requirements.

2.2 Account Registration
To access certain features, Users must create an account. You are responsible for safeguarding your login credentials and ensuring the accuracy of your account information. Notify us immediately of unauthorized use of your account.

3. Use of the Platform
3.1 License
Wheel Have grants you a limited, non-exclusive, non-transferable, and revocable license to use the Platform under these Terms.

3.2 Prohibited Conduct
You agree not to:
– Violate any applicable laws or third-party rights.
– Post false, misleading, or defamatory information.
– Engage in fraudulent or deceptive practices.
– Use the Platform for unauthorized purposes.

4. Listings, Transactions, Returns, and Complaints
4.1 Listings
Sellers must provide accurate descriptions, pricing, and terms for their Listings. Misleading or false Listings may result in penalties or removal from the Platform.

Sellers of **second-hand items** must still declare accurate product details, HS codes (where required), and the country of origin. Second-hand or peer-to-peer status does not exempt goods from customs duties, VAT, GST, or other import taxes.

4.2 Transactions
Wheel Have facilitates transactions between Buyers and Sellers but is not a direct party to these transactions. We do not guarantee the quality, legality, or accuracy of Listings or the performance of Buyers or Sellers.

4.3 Returns and Refunds
– Returns are permitted if the item is not as described or arrives damaged.
– Returns for “change of mind” are not allowed unless explicitly offered by the Seller in the Listing.

4.3.1 Returns Period
– Buyers must notify the Seller within 14 days of receiving the product to initiate a return.
– Sellers offering discretionary returns (e.g., “change of mind”) must clearly state this in their Listings.

4.4 Disputes and Complaints
Users must first attempt to resolve disputes directly through the Platform’s messaging system. If unresolved, contact Wheel Have Customer Support at contact@wheelhave.com with evidence (photos, tracking details, messages).
Wheel Have will review and respond within 5 business days.

5. Fees, Payments, and Taxes
5.1 Fees
Sellers may incur fees for Listings or transactions. These will be disclosed prior to application.

5.2 Payment Processing
Payments are processed via third-party providers (e.g., PayPal, Stripe). Wheel Have does not store sensitive payment information.

5.3 Taxes, Duties, and Import Charges
– **Buyers**: You are responsible for paying any import duties, VAT, GST, or customs charges that apply to your order. Where required by law, Wheel Have will collect and remit taxes at checkout (e.g., UK VAT on orders ≤ £135, EU VAT on imports ≤ €150 under IOSS, Australian GST on low-value imports ≤ AUD $1,000, New Zealand GST on low-value imports ≤ NZD $1,000).
– **Sellers**: You must cooperate by providing accurate product details, HS codes, and origin information so that taxes and duties can be calculated and applied correctly.
– **Second-hand items**: Import taxes apply to used goods in the same way as new goods when shipped across borders. Being a peer-to-peer or resale item does not exempt it from customs charges.
– **United States**: At present, Wheel Have does not support shipping to the United States due to recent changes in U.S. import law eliminating the duty-free threshold. US shipping will resume when compliant landed-cost systems are in place.

6. Buyer and Seller Responsibilities
6.1 Buyers
– Review Listings carefully before purchasing.
– Pay promptly and follow return procedures if applicable.
– Understand that international orders may be subject to taxes, duties, and clearance fees.

6.2 Sellers
– Provide accurate descriptions and fulfill orders promptly.
– Respond to Buyer inquiries and resolve disputes professionally.
– Accurately declare the nature of goods, including second-hand status, HS codes, and origin.

7. Privacy and Cookies
Your use of Wheel Have is subject to our Privacy Policy and Cookie Policy.

8. Intellectual Property
All content, trademarks, and intellectual property on the Platform are owned by Wheel Have or its licensors.
By submitting content (e.g., Listings, reviews), you grant Wheel Have a non-exclusive, worldwide license to use it in connection with our services.

9. Limitation of Liability
The Platform is provided “as is” without warranties. Wheel Have is not liable for indirect, incidental, or consequential damages.

10. Governing Law and Dispute Resolution
These Terms are governed by the laws of Victoria, Australia. Disputes will be resolved in the courts of Victoria, Australia.

11. Changes to These Terms
We may update these Terms periodically. Continued use of the Platform constitutes acceptance of any updates.
